What are trademarks for

A trademark is a designation that is capable of distinguishing the goods or services of one person from those of others and can be represented graphically. Such signs may be words, including names of persons, letters, digits, numbers, pictures, figures, the shape of goods or their packaging, a combination of colors, sound designations or any combination thereof.
 
Ownership of a trademark is acquired by registration from the date of filing of the application.
 
The right to registration belongs to the first applicant.
 
The right to a trademark is an exclusive right.
 
The right to a trademark includes the owner's right to use it, to dispose of it and to prohibit third parties from using in the course of trade without his consent a mark which:
 
  1. is identical to a mark for goods or services identical to those for which the mark is registered;
  2. by virtue of its identity or similarity with the trademark and the identity or similarity of the goods or services related to the trademark and the mark, there is a likelihood of consumer confusion, which includes the possibility of associating the mark with the trademark;
  3. is identical or similar to the mark for goods or services that are not identical or similar to those for which the mark is registered, where the earlier mark enjoys a reputation in the territory of the Republic of Bulgaria and unjustified use of the mark would unfairly benefit or damage the distinctive character or reputation of the earlier mark.
